For the purposes of this Privacy Policy, “Customer” or “Customers” shall mean any individual or individuals interested in the products and services offered by Válvulas Arco. Before a Customer provides their personal data, Válvulas Arco, as data controller, will request their express consent to this Privacy Policy, where necessary, and to any other matter that may require the Customer’s prior consent.
The purpose of this Privacy Policy of Válvulas Arco is to give transparency to the information regarding how we process the data of Customers and protect them throughout the commercial relationship entered into between Válvulas Arco and the Customer. The Customer is hereby informed that Válvulas Arco may process the personal data provided through the various means made available, for the purposes indicated below:
The following constitutes the legal basis for the processing by Válvulas Arco of customer data:
At the time of registration, Válvulas Arco will collect and process any personal data of the Customer that are essential for providing information regarding its products and services. If the Customer decides to purchase one of Válvulas Arco’s products or services, Válvulas Arco will collect the data necessary for managing the sales process (including, without limitation, first name, surnames, company name, Tax Identification Number (CIF), National Identity Card number, address, bank account number, telephone number, etc.).
The Customer knows and accepts that the failure to provide certain personal data may mean that Válvulas Arco will be unable to provide all of the services to which such data relate. Under no circumstances will Válvulas Arco use such data for purposes other than those expressly indicated herein. During the registration process, the Customer may be informed of the non-mandatory nature of the collection of some of the data for Válvulas Arco’s commercial activities.
Válvulas Arco stores the personal data of its customers for the period of time necessary for providing its services and fulfilling the purposes set out in this Privacy Policy, and where a user has given their consent for any request in particular, for the period of time necessary for resolving the enquiry and for the duration of the relationship between Válvulas Arco and the Customer and for the period of time that the latter consents to the processing of their personal data. In any event, including upon termination of the relationship, the personal data may be stored for the period of time necessary for providing the services, for assuming liability for any obligations arising out of the services, for ensuring the security of the data and preventing fraud or abusive practices or for any other purpose required by law.
In particular, in relation to the personal data provided in CVs submitted for job vacancies and during the selection process, the personal data will be stored for the duration of the selection process and thereafter for a period of one year from the date on which the job application is received or from the applicant’s last indication of interest in a vacancy of Válvulas Arco or from the applicant’s last communication, including any updates made to their profile. At the end of the aforementioned period, their data will be deleted.
To ensure the optimum provision by Válvulas Arco of the services that it offers, it may be necessary for other third-party providers of services to Válvulas Arco to have access to the Customer’s data. For example, the financial and credit risk management institutions with which Válvulas Arco works may have access to customer data within the context of the commercial relationship, on the basis always of Válvulas Arco’s legitimate interest in correctly and efficiently providing its services.
Likewise, Válvulas Arco may choose to store the Customer’s personal data on third-party infrastructure. Therefore, when accepting this Privacy Policy, the Customer understands that some of the aforementioned service providers may be located in countries outside the European Economic Area. In such cases, the transfers are based on the authorization of the Directorate of the Spanish Supervisory Authority, on standard clauses approved by the Commission. To obtain further information regarding the aforementioned safeguards or the fact that they have been provided, the Customer may contact Válvulas Arco through the means indicated in section I. In addition to the above, Válvulas Arco may make transfers or disclosures of personal data in order to fulfill its obligations with the public authorities where this is required under the legislation applicable from time to time and, where applicable, to other organizations such as the state security forces and law enforcement agencies and the courts.
Válvulas Arco informs the Customer that they may exercise their right to access, rectify, erase and object to the processing of their data, their right to data portability and their right to restrict the processing of their data, as well as their right to reject the automated processing of the personal data collected por Válvulas Arco. Such rights may be exercised free of charge by the Customer and, where applicable, by the person acting on their behalf, by means of a signed written request sent to the following address: Avenida del Cid, 16 – 46134 Foios – Valencia (España). Such request shall indicate in the subject the reference “Data protection /Válvulas Arco” and shall include the following details: first name and surnames of the Customer; address for the purposes of notices; supporting documentation identifying the Customer and the specific request that is made. In the event of acting on behalf of the Customer, proof of power of attorney must be provided by means of a reliable document. Likewise, the Customer may exercise the aforementioned rights by sending an email to RGPD_compliance@valvulasarco.com
In addition to the above rights, the Customer will have the right to withdraw the consent given at any time by means of the aforementioned procedure, without such withdrawal of consent affecting the lawfulness of the processing carried out before its withdrawal. Válvulas Arco may continue to process the Customer’s data where permitted to do so under the applicable legislation.
The Customer has the right to withdraw at any time the consent given to commercial communications by means of notice to Válvulas Arco stating that they do not wish to continue receiving commercial communications. For such purpose, the Customer may withdraw their consent as indicated in the foregoing section.
Válvulas Arco informs the Customer that they have the right to lodge a complaint with the relevant supervisory authority where they deem this appropriate ( www.aepd.es )
Válvulas Arco undertakes to fulfill its obligation of confidentiality in respect of any personal data, as well as its obligation to store them and take the necessary measures to prevent the alteration, loss or unauthorized processing of or access to such data, in accordance with the applicable legislation. Válvulas Arco has established the necessary technical and organizational security measures in order to ensure the security of any personal data and to prevent the alteration, loss or unauthorized processing of or access to such data, taking into account the state of technology, the nature of the data and the risks to which they are exposed, resulting from human actions or from the physical or natural environment, in accordance with the provisions of the applicable legislation.
